1. SCOPE OF APPLICATION

As used in this Privacy Policy (the “Policy”), the terms “use” and “processing” of personal data (as defined below) include the implementation of personal information for statistical or other analysis and the use or processing of personal information in any way, including, but not limited to, collection, storage, evaluation, modification, deletion, use, combination, disclosure, and transfer as stated in this Policy.

A2B (“we” or “our”) provides this Policy to inform you of our procedures regarding the collection, use, and disclosure of Personal Data from any person who uses the Website, the Application, and the services provided therein (the “Users” or “you”).


2. WHAT INFORMATION DO WE COLLECT?

A2B collects and processes two types of information:

  1. Information that you provide to us.
  2. Information related to your use of the Application and/or Website (collectively, “Personal Data”).

Personal Data has the meaning assigned to it under applicable Belgian and European law.


2.1 Information You Provide to Us:

Contact Directory

If you give us permission to use your phone’s directory/contacts, the ability to share address information from your phone’s directory will be supported.

Account

When you choose to register for our services, we will ask you to provide your contact details (e.g., your name, address, phone number, and email address). This is necessary to, for example, allow you to book a ride or receive a payment confirmation.

We may also use your email address to send you more information about our services or to assist you in case of an issue.

When you create an account, make a booking, send us an email, or communicate with our customer service, you voluntarily provide us with certain individually identifiable information.

This Personal Data may include, but is not limited to:

  • Your name
  • Your physical address
  • Your email address
  • Your phone number

If you provide details about another person, you hereby confirm that you fully comply with the GDPR and that you have obtained all necessary authorizations for this purpose and/or that you are legally responsible for the said person.

We may also process additional information that you may choose to provide on your account (i.e., Personal Data that is not required during the registration process), such as:

  • Home or office addresses
  • Email addresses
  • Passenger contact details
Location Data

To use the Website, the Application, and the services offered therein, and to help calculate ride prices and schedules between your locations, departure and destination locations, start and arrival times, travel date, and trip duration may be collected.

When you choose to use the Application on any mobile device, you may or may not use geolocation options: when you decide to book a ride, you can choose to enable this option so that we can locate you in relation to our driver or manually enter your address. It is possible to disable the geolocation option on your mobile phone at any time, and we will only use your location when you use our services on the Application. Address coordinates, whether obtained through geolocation or manual input, are stored in the logs by A2B.

Banking Details

We will request your payment information (billing information, bank account, or other payment details) if you wish to proceed with a booking. These details will not be stored by A2B (only a token number and the last four digits of your credit card number are processed by A2B) and will be exclusively handled by our external secure payment providers.

Order Details

We may collect personal data related to your bookings, such as the date of your ride, your travel history, or any potential claims.

Additionally, A2B will also collect the necessary information to allow you to access your booking history.

Correspondence

When you contact our customer service or any A2B staff member, we may keep a record of this correspondence and collect the necessary information to classify your request, respond to it, and, if necessary, investigate any violations of our Terms and Conditions or this Policy. Additionally, your contact details may be used to inform you of changes to our Terms and Conditions or this Policy.

Contests, promotions and feedback

When you participate in a contest or promotion organized by A2B, we will request the necessary personal data to manage the relevant contest or promotion, such as a name, email address, phone number, age, and/or place of residence. When you respond to a survey or provide us with feedback on the use of the Application and/or Website, we may ask for certain Personal Data to follow up on your feedback.

3. Information We Learn About You by Using the Application and/or Website:

We may process your IP address and certain non-personal or aggregated data about how and when you use the Application and/or Website. This information is generally technical in nature (device settings and information, including but not limited to Internet Protocol (IP) address, login data, browser type and version, time zone and location, browser plug-in types and versions, operating system and platform, and other technologies on the devices you use to access this Website and/or the Application, etc.), as well as behavioral in nature (actions you have taken on the Application and/or Website, including but not limited to access times, requested pages, executed actions, etc.). This data is used to compile statistical reports on the use of our Application and/or Website.

4. PURPOSE OF DATA PROCESSING

A2B processes Personal Data only for the following purposes:

4.1 Performance of a Contract (Article 6, §1, b) of the GDPR):

We process certain personal data (name, phone number, gender, email address, postal address, location data, travel schedules) to perform the contract between you and us, allowing us to process your bookings on the Application and/or Website, enable you to book a ride via the Application, confirm reservations, inform you in case of an issue, provide you with a summary of your trips, handle your requests via our customer service, or resolve any problems.

In the event that you participate in a contest or promotion organized by A2B, we also process certain personal data to manage said contest or promotion (the details of the required personal data will be outlined in the contest or promotion rules).

For the execution of our services, we may use third-party providers acting as data processors. These third-party service providers will only have access to your personal data to the extent necessary (i.e., to perform specific tasks on our behalf, such as data storage, booking processing, payment services, and targeted communication via the Application). Once this third-party service provider has completed their specific task and their legal relationship with A2B ends, they will no longer have access to your personal data unless required by law.

Our subcontractors are listed in a processing activities register (kept internally). We ensure that all our subcontractors provide the same level of protection for your personal data as we do (including subcontractors located outside the European Economic Area—please refer to section 4 below on international transfers).

If you wish to learn more details about which third parties your personal data has been shared with and which personal data has been disclosed, please refer to section 7 below on your rights.

4.2 Compliance with Legal Obligations (Article 6, §1, c) of the GDPR):

We may also process your personal data to comply with the law, fulfill all legally required documentation in each country/region where the user or A2B operates, in case of illegal use of our services, or when we receive orders from legal authorities.

4.3 Legitimate Interests (Article 6, §1, f) of the GDPR):

Beyond collecting your personal data to provide our services or comply with legal obligations, we may collect and use your personal data for the following purposes:


4.3.1 Improving the User Experience:

Tracking your use of the Application and/or Website will allow us to personalize our services based on your needs and process the data uploaded related to your profile, such as rides and booking preferences, travel history, or preferred addresses.

This will allow us to make suggestions and recommendations to the User regarding our services. It will enable you to use the Application and/or Website properly.

Additionally, it will help us gain insights into User preferences and general trends on the Application and/or Website to improve the quality of the Application and/or Website and our services.


4.3.2 Providing Customer Service:

We may collect additional personal data for the general administration of your account, including:

  • Providing specific information about available services
  • Sending communications via the Application (e.g., upcoming changes or improvements)
  • Answering your questions, handling your requests, or resolving issues

We may also verify your compliance with your obligations outlined in our Terms and Conditions and this Policy, as well as investigate any instances of fraud or violations of applicable laws and regulations.


4.3.3 Conducting Marketing Activities:

We may process your personal data to contact you with:

  • Newsletters
  • Personalized suggestions
  • Exclusive information about A2B
  • Products or services similar to those we offer
  • Related information (such as events, application updates, contests, promotions, or details about our Website or Application)

These marketing activities will only be carried out by us. We will always request your explicit consent before sharing your personal data with third parties for marketing purposes.

You can opt out of A2B or third-party marketing promotions and email communications at any time.

If you no longer wish to receive commercial communications from us or third parties, you can unsubscribe from these communications at any time by emailing us at info@a2bswiss.ch.


4.3.4 Producing Statistics and Conducting Statistical Analysis:

We may generate anonymous statistics about the Application (its usage and users) and the Website to improve both and perform statistical analysis.


4.3.5 Sharing Information with Third Parties:

Anonymous information about visitors, Application users, and Website usage may also be disclosed to third parties for:

  • Marketing purposes
  • Advertising and promotional purposes
  • Statistical purposes

If you wish to know which third parties your personal data has been shared with and which personal data has been disclosed, please refer to section 7 below on your rights.


5. Other Processing Activities:

We will request your consent before using personal data for any purposes other than those stated in this Policy.

However, if you decide to add or provide additional personal data to your personal settings that is not required during the registration process, you explicitly consent to A2B processing this additional personal data in accordance with this Policy.

6. INTERNATIONAL TRANSFERS

Some of our external service providers are based outside the European Economic Area (“EEA”), meaning that the processing of your personal data will involve a transfer of data outside the EEA.

Our external third parties are listed in a processing activities register (kept internally). We ensure that all our external third parties provide the same level of protection for your personal data as we do.

Whenever we transfer your personal data outside the EEA, we ensure that a similar level of protection is applied by implementing appropriate safeguards.

7. SECURITY OF YOUR PERSONAL DATA

To prevent loss, misuse, and alteration of your personal data, A2B has implemented a range of technical and organizational security measures that meet or exceed industry standard technologies, ensuring the confidentiality of your personal data and your online security. However, A2B cannot guarantee that unauthorized access will never occur.

A2B does its best to protect the confidentiality and security of your personal data.

In the event of a Personal Data Breach, A2B is committed to notifying the Swiss Data Protection Authority without delay and, if possible, no later than 72 hours after becoming aware of such a breach.

A2B shall not be held responsible for any direct or indirect damages resulting from unauthorized or illegal manipulation by third parties.

You may not disclose or share your account with third parties. If your phone has been stolen or your account is at risk of being hacked (for example, if you have changed your phone number or lost your computer), please inform us immediately by sending an email to info@a2bswiss.ch

8. DATA RETENTION PERIOD

We do not process your personal data for longer than necessary for the purposes set out in this policy (including to meet legal, accounting, or reporting requirements): we store your personal data as long as your account is active or when processing your personal data is necessary to allow you to use our application.

To determine the appropriate retention period for personal data, we consider the amount, nature, and sensitivity of the personal data, the potential risk of harm from unauthorized use or disclosure, the purposes for which we process your personal data, whether we can achieve those purposes through other means, and applicable legal requirements.

Your personal data is deleted or anonymized no later than five years after your last use of our application or the deletion of your account.

In some cases, we may anonymize your personal data (so that it can no longer be associated with you) for research or statistical purposes, in which case we may use this information indefinitely without prior notice.


9. YOUR RIGHTS

Exercising your rights is free of charge and can be done at any time, provided the law allows it. You can view, update, modify, or delete your personal data at any time. Please promptly update your personal data if any changes occur.

If you wish to delete your account or, more generally, exercise your right to be forgotten, you can send us an email at info@a2bswiss.ch, and we will process your request. However, please note that some of your personal data is necessary for the execution of the contract.

If and to the extent provided by Swiss and European law, you have the right:

  • To obtain confirmation from A2B as to whether or not your personal data is being processed and, if so, to access that data.
  • To obtain from A2B, without undue delay, the rectification of inaccurate or incomplete personal data.
  • To obtain from A2B the erasure of personal data.
  • To obtain from A2B the restriction of processing of your personal data.
  • To receive your personal data in a structured, commonly used, and machine-readable format and have that data transmitted.
  • To object to the processing of your personal data and to object at any time, without justification, to the processing and/or transmission of your personal data to third parties.

In many cases, you can update or modify your personal data directly within your account settings.

You have the right to file a complaint with the competent supervisory authority (Swiss Data Protection Authority) if you believe that the processing of your personal data violates applicable law. More information can be found on the Swiss Confederation’s official website.

10. CHANGES TO THIS POLICY

We reserve the right to modify this policy at any time. Any changes to the Policy will be published on the Application and the Website.

In the event of significant changes to the Policy that result in A2B using your Personal Data in a way that is substantially different from what was stated at the time of collection, we will provide notice on the Application and/or send you a notification by email.


11. GOVERNING LAW AND COMPETENT COURTS

This Policy is governed and interpreted in accordance with Swiss law, which exclusively applies to any potential disputes.

Any dispute arising from or related to this Policy will be settled exclusively by the competent courts of Switzerland.
